Boundary Disputes
These can generate considerable worry, lost sleep and substantial amounts of lost money. Ironically, much of this is often unnecessary as the disputants’ contentions are frequently misconceived arising from a widespread misunderstanding of how legal boundaries are mapped, recorded and identified within England and Wales (the ‘General Boundaries’ system). Once explained, many apparently irreconcilable differences can be well on the way to being resolved.
Our director, Andrew Fairbairn, has practised as a Land Surveyor (both in the UK and abroad) and has experience of dealing with such matters through:
- Meetings with landowners at an early stage of a dispute intended to unblock an impasse and enable a resolution before parties become entrenched and costs begin to escalate; and
- Acting as an Expert Witness if the matter does result in legal action and Expert Reports are required.
Advising on disputes of this nature requires experience, objectivity and independence as the reports, accompanying evidence and stated conclusions need to be able to stand up to rigorous court procedures.
